Terms of Service

By accessing or using FutureGain ("we", "our", "us", or the "Service"), operated by DexoSoft Solutions, you agree to these Terms of Service. Please read them carefully. If you do not agree, do not use the platform.

1. Eligibility & Account

You must be at least 18 years old, a resident of India, and legally capable of entering into binding contracts to use FutureGain. By using the Service, you confirm that you meet these requirements.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorised use at hello@dexosoftsolutions.com.

2. No Investment Advice — SEBI Disclaimer

You must consult a SEBI-registered Investment Adviser or Research Analyst before making any investment decision. Past signal performance is not indicative of future results.

3. Market Risk & No Guaranteed Returns

Investing in the stock market involves substantial risk of financial loss, including the possible loss of your entire invested capital. Past performance, backtested results, win-rate statistics, and AI-generated forecasts do not guarantee future results.

FutureGain does not guarantee any level of return on your investments or trades. Any reference to historical accuracy or win-rates is informational only and must not be construed as a promise of future performance.

4. ARJUN AutoTrader — Automated Trading Authorisation

• You remain solely responsible for all trades executed by ARJUN. FutureGain is a technology platform — it does not hold, manage, or custody your funds.
• You grant FutureGain a limited, revocable licence to use your broker API credentials for the sole purpose of executing trades on your behalf while the bot is active.
• ARJUN executes orders according to the rules and limits you configure (capital, loss limits, position caps, mode) during market hours (9:15 AM–3:30 PM IST) without requiring per-trade confirmation from you. It is a rule-based order-execution tool, not a discretionary manager: you set the rules, and you acknowledge and accept that orders are placed under them automatically.
• You may disable automated trading at any time from your AutoTrader Settings page. Disabling the bot does not close existing open positions — you must manage those manually.
• FutureGain does not guarantee trade execution, fill prices, or broker API availability. Technical failures, broker outages, and market conditions may cause delays or missed trades.

5. Broker API Credentials

When you link your broker account, you provide your API key and secret (or complete an OAuth flow). These credentials are encrypted using AES-256-GCM and stored securely. By providing these credentials, you:

• Confirm you are the authorised owner of the broker account
• Accept that you have reviewed and comply with your broker's own API terms of service
• Authorise FutureGain to use these credentials to execute trades as instructed by the ARJUN bot
• Accept that FutureGain will not use your credentials for any purpose other than executing your configured trading strategy

6. Limitation of Liability

To the maximum extent permitted by applicable law:

• FutureGain and DexoSoft Solutions shall not be liable for any trading losses, missed opportunities, or financial harm arising from use of the platform or reliance on any AI signal, score, or recommendation.
• Our total aggregate liability to you for any claim arising out of or relating to this Service is limited to the subscription fees you paid in the 30 days preceding the claim.
• We are not liable for losses caused by broker API failures, internet outages, exchange halts, force majeure events, or any factor outside our reasonable control.
• We are not liable for indirect, consequential, incidental, or punitive damages of any kind, even if we have been advised of the possibility of such damages.

7. Acceptable Use

You agree not to:

• Attempt to reverse-engineer, copy, or redistribute the platform or its signals
• Share paid account credentials with others or resell access without authorisation
• Use automated tools to scrape, harvest, or bulk-download signal data
• Use the platform to manipulate securities markets or engage in any activity prohibited by SEBI or SCRA
• Provide false information during account creation or KYC processes

8. Subscriptions & Refunds

Paid plans are billed on a recurring basis through Cashfree. By subscribing, you authorise recurring charges until you cancel. Cancellation takes effect at the end of the current billing period.

Refund terms are governed by our Refund & Cancellation Policy. Our satisfaction guarantee covers only subscription fees — it does not cover or imply any guarantee of investment returns or trading profits.

9. Intellectual Property

All platform code, AI models, signal algorithms, design, and content are owned by DexoSoft Solutions or its licensors. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the platform for personal, non-commercial purposes only.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be:

1. First attempted to be resolved amicably within 30 days of written notice
2. If unresolved, referred to arbitration under the Arbitration and Conciliation Act, 1996 (a sole arbitrator, venue: India, language: English)
3. Courts of India shall have exclusive jurisdiction for any matter not subject to arbitration

Nothing in this clause prevents either party from seeking urgent injunctive relief.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email and/or a prominent notice on the platform at least 7 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
